How Do Minnesota Courts Determine Custody?

Minnesota’s family law courts do not have one simple formula for determining custody and visitation. Whether you and your spouse are divorcing or you were not married to begin with, judges tend to favor joint custody whenever possible. When awarding custody, the judge will consider several factors:

  • The ability of each parent to care for the child
  • The child’s relationship with each parent
  • The location of each parent
  • The child’s involvement with school, church and other community activities
  • The presence or history of substance abuse, mental illness or domestic violence
